Make Your Role in Your Stepchild's Life Legal
You already act as a parent. A stepparent adoption makes it official: you become your stepchild’s legal parent, with the same rights and responsibilities as any other parent, including inheritance and the authority to make medical and school decisions.
I’m Chuck Buchan, a stepparent adoption attorney in Little Rock, and I handle adoptions across Arkansas for a flat fee. You’ll know the cost up front, and I handle the consent paperwork, the court filing, and the final hearing from start to finish.
How We Handle Your Stepparent Adoption
Every stepparent adoption follows the same path, from the first conversation to the signed decree. I handle each stage and explain it in plain language.
CONSULTATION
I start with your family: who the child’s other legal parent is, whether that parent is likely to consent, and what Arkansas requires in your situation. You leave with a clear plan and a flat fee.
CONSENT FROM THE OTHER PARENT
Arkansas generally requires written consent from the child’s other legal parent. I prepare the consent forms, explain what the signing parent is agreeing to, and make sure they are signed and filed the way the court requires.
IF THE OTHER PARENT WON’T SIGN
If the other parent refuses to sign or has been absent from the child’s life, I tell you whether the adoption can still go forward. The court can excuse consent when a parent’s rights were terminated or when a parent has gone at least a year without significantly communicating with or supporting the child.
THE PETITION AND FILING
I draft the petition and supporting documents, file them in the correct Arkansas circuit court, and answer the court’s questions along the way. Arkansas does not require a home study for a stepparent unless the judge orders one.
THE FINAL HEARING
You, your spouse, and the child being adopted need to attend and testify. I prepare your family for what the judge will ask, so the hearing feels like a family milestone, not an ordeal.
THE FINAL DECREE
Once the judge signs the decree, you are your stepchild’s legal parent for all purposes, including inheritance. I help you update the child's birth certificate and get certified copies of everything needed to change other documents, like a Social Security card, driver's license, etc.

We cannot recommend Chuck Buchanan highly enough. Throughout our adoption process, Chuck was professional, knowledgeable, and incredibly responsive. He communicated clearly every step of the way, answered our questions quickly, and always took the time to make sure we understood what was happening. Our adoption involved Cherokee Nation and ICWA considerations, which added additional complexity to the process. Chuck handled every challenge and guided us through each step with patience and expertise. What stood out most was how much he genuinely cared. He wasn't just our attorney—he was someone who checked in on us, kept us informed, and provided reassurance during what can be an emotional and stressful journey. His personable approach made us feel supported and valued from beginning to end. If you are looking for an adoption attorney who is knowledgeable, responsive, compassionate, and truly invested in his clients, we would absolutely recommend Chuck Buchanan.Posted on Google![]()

I highly recommend Chuck for any adoption case! I suddenly had the opportunity to adopt my step-son and Chuck instantly took the case and managed to get all papers signed in less than a week. He also managed to get us a hearing speedily (in literally less than a week from when we filed). He was super respectful and answered all of my questions and explained everything to me!
Common Questions About Stepparent Adoption in Arkansas
Does my stepchild's other parent have to agree to the adoption?
Usually yes. Arkansas requires the written consent of the child’s mother and, in many cases, the father (Ark. Code § 9-9-206). The court can excuse consent in specific situations, such as terminated parental rights or a parent who, for at least one year, failed significantly and without justifiable cause to communicate with or support the child (§ 9-9-207).
What if the other parent signs and then changes their mind?
A parent can withdraw consent within ten calendar days after signing, or five if the parent waived the ten-day period. In a stepparent adoption, the court may excuse that period for a biological parent. No one can withdraw consent after the decree is entered.
Does my stepchild have to agree to the adoption?
If the child is 12 or older, yes. The child consents at the hearing, and the court can waive that only if it finds by clear and convincing evidence that waiving it is in the child’s best interest.
Do I need a home study to adopt my stepchild?
Generally no. Arkansas exempts a stepparent petitioner from the home study requirement unless the court directs one in your case.
How does a stepparent adoption affect inheritance?
After the final decree, your stepchild is your legal child for all purposes, including inheritance, and the other biological parent’s rights and responsibilities end (§ 9-9-215). Your child’s legal relationship with your spouse does not change.
One Attorney and One Flat Fee for Your Stepparent Adoption
A stepparent adoption is a short, specific court case, and it moves smoothly when the consent forms and the petition are right the first time. I handle stepparent adoptions, so I know what Arkansas courts look for in both.
You work with me directly, not a rotating staff. The flat fee covers your stepparent adoption from consultation through the final hearing, and I keep you and your spouse updated at each stage so you are never guessing about what comes next.
If the other parent is hard to reach or unwilling to sign, you do not have to handle that conversation alone. I tell you where the case stands and what the court requires.
Take the First Step Toward Adopting Your Stepchild
Whether you are just starting to think about adopting your stepchild or you are ready to file, I can tell you what Arkansas requires and what comes next. Your consultation covers your family’s situation, the other parent’s consent, and the flat fee.
